National Conference on Reparation Rights Held

6 March, 2024, Kathmandu: Advocacy Forum-Nepal (AF), International Commission of Jurists (ICJ), Human Rights and Justice Centre (HRJC), Conflict Victim Women National Network (CVWN), Redress, and Global Survivors Fund (GSF) jointly organized a national conference on Realizing the Right to Reparation of Victims of Human Rights Violations in Nepal Wednesday.

Former members of the judiciary, parliamentarians, victim group representatives, civil society delegates and international experts attended the conference to share their experiences about providing reparation measures for victims. The event was divided into two sessions.

Speaking at the first session of the conference, ICJ Commissioner and Former Chief Justice of the Supreme Court of Nepal Kalyan Shrestha said that the state needs to analyse the injuries sustained by the victims before determining reparations for them.

Sabitri Khadka, Secretary at the CVWN, shared the victims' experience in accessing reparation and interim relief programmes. She talked about the need to provide an identification card that establishes the victim's identity, dignity and respect. She also asked the state to prioritize victims in employment opportunities.

Juan Fernandez, Senior Human Rights Officer at the United Nations Resident Coordinator Office, talked about the best practices in designing reparation policies. He emphasized the fact that reparations need to be adequate, prompt, effective and comprehensive.

Speaking at the event, Senior International Legal Advisor for the ICJ and AF's Founder Dr. Mandira Sharma said that there are some positive provisions in the bill to amend the Investigation of Disappeared Persons, Truth and Reconciliation Act in providing reparation to victims of human rights violation. However, the definition of victims of rights violations in the bill is not comprehensive enough, thus creating a risk of excluding many victims from reparation measures.

Five parliamentarians in the Sub-committee of the Law, Justice and Human Rights Committee-- Ambar Thapa of CPN (Unified Socialist), Mahesh Bartaula (CPN UML), Dhruba Bahadur Pradhan (RPP), Ranju Kumari Jha (JSP) and Sushila Thing (NC) -- shared their experiences in framing the bill to amend Investigation of Disappeared Persons, Truth and Reconciliation Commission Act, with reparation for conflict victims as the most important component.

During the second session, Hugo van der Merwe, Head of National Advocacy and Technical Support at the GSF and Sikha Bhattarai, GSF's Project Coordinator for Nepal talked about the good practices and lessons learned regarding reparation for victims of conflict-related sexual violence based on a co-creation model. They explained GSF's model of "act, advocate and guide" for co-implementing projects with rape and sexual violence survivors.

Following this, Secretaries at the Ministry of Internal Affairs and Law in five different provinces gave presentations on reparation-related plans, policies, and initiatives developed and implemented by provincial governments. Office of the Prime Minister and Council of Ministers Joint Secretary Rajendra Thapa complimented the works done by the provincial officials and said that there is a need to build a unified plan for the implementation of reparation measures for the victims.

An open floor discussion was done following these presentations.

Dr. Mandira Sharma gave the closing remarks and vote of thanks to end the programme.
