27 October 2024, Kathmandu: The Supreme Court of Nepal on Sunday issued a mandamus order to Child Reform Home (CRH) Bhaktapur to transfer a juvenile to their parents’ custody.
Hearing a habeas corpus writ petition filed by Advocacy Forum-Nepal’s Programme Coordinator Advocate Kumar Prasad Thapaliya, the joint bench of Justices Til Prasad Shrestha and Bal Krishna Dhakal issued the order. Additionally, the bench, through certiorari, revoked the District Court Baitadi’s order of sending the juvenile to judicial custody.
The court has asked petitioner Advocate Thapaliya to transfer the juvenile from CRH to parental custody. She is to be presented to District Court Baitadi to stand the trial.
Juvenile “Patan I” was accused of the crime of attempt on life and sent to judicial custody on 1 July 2024. She was pregnant at the time of the arrest. Considering her condition and her alleged crime attracting not more than 10 years of imprisonment, the court ordered her release.
