5 September 2011. Bhutanese refugees Ms. Suk Maya Subba, Ms. Dolma Tamang (died in jail on 05 July 2011), Mr. Nar Bir Rai, Mr. Janga Bahadur Rai, Mr. Jari Lal Rai and Mr. Jas Bahadur Rai, who were arrested on 21 April 2009 on suspicion of involving in the murder of another Bhutanese refugee Shanti Ram Nepal, are released after they were found innocent. On 04 September 2011, after the final hearing on the case District Court, Jhapa acquitted them from the accusation. Deciding the allegation against the accused could not be established, the single bench of Justice Ramesh Raj Pokhrel gave the verdict to release them.
On 18 May 2009 their case was filed under the Chapter of Homicide before District Court, Jhapa. On 20 May 2009, the single bench of Justice Shaligram Koirala had decided to send them to jail based on the evidences available at the moment.
During an interview with AF staffs the victims had complained of physical and mental problems caused by the severe torture inflicted on them during an inquiry in Armed Police Force Camp, Beldangi and Armed Police Force, Padaguji in Jhapa district. AF regularly followed them in Central Jail Branch, Jhapa.
As the victims had complained of physical and mental problems caused by police torture, AF, on 05 August 2010, managed to take them to a psychiatrist in Koshi Zonal Hospital. Likewise, on 11 August 2011 AF managed to take them to Mechi Zonal Hospital for their medical treatment. As of 09 September 2011 they are in Bhutanese refugee camp, Beldangi, Jhapa district. Advocacy Forum – Nepal provided them medical treatment and free legal aid.
Meanwhile, it has been reported that one of the main perpetrators is serving in Sudan under UN Peace Keeping Mission. But it has not been proved yet.
