11 July 2012. The Kathmandu District issued an order on 9 July 2012 to award compensation amounting NRs 10, 000/- (US$ 112) to torture survivor Shiv Dhan Rai under the Torture Compensation Act (TCA) – 1996. The victim was severely tortured under the allegation of carrying fake documents.
Shiv Dhan Rai, 18, a permanent resident Khotang district and studying in Kathmandu, was arrested by the police on 20 January 2010 at around 12.30 pm for allegedly carrying fake documents, which according to the victim, were given to him by a student leader to handover them to an unidentified man. But on his way to the man, he was arrested by 5 plainclothes policemen and was taken to Metropolis Police Range (MPR), Hanumandhoka. After being held into custody, Rai was brutally tortured on various parts of the body by police personnel for 2 hours. He was released on 16 February 2010 on bail.
With legal assistance of Advocacy Forum, Rai had filed a torture compensation case before the Kathmandu District Court on 12 March 2010.
