Torture Survivors Awarded Compensation

26 May 2011. The District Court of Dolakha has issued two corresponding orders on 22 May 2011 to award compensation amounting NRs 15000/- to torture survivors Mahima Kusule and Peema Dorje Tamang. Both victims were severely tortured under the allegation of theft by police personnel.

Mahima Kusule, 26, a permanent resident of Bimeshowar Municipality-7, Chisapani Dolakha district was arrested by DPO Dolakha on 22 July 2010 for allegedly stealing NRs. 6000/- from her neighbor. Ms Kusule was ruthlessly tortured by Sub-Inspector Rajiv K.C. and Head Constables Bhim Basnet and Nirmala Pokhrel after she was being held in detention.

Peema Dorje Tamang a permanent resident of Lakuri Danda VDC-8, Chitre, Dolakha district was arrested on 5 June 2010 and tortured for three consecutive days by Sub-Inspector Rajiv K.C. and Head Constable Bhim Basnet and constable Nava Raj Pokhrel.

AF had assisted both victims to file torture compensation under TCA 1996 on 13 August 2010. Dissatisfied with the court’s verdict that no departmental action was taken against the perpetrators in both cases, the victims have decided to bring the case before the Appellate Court.
