Torture Survivor Provided Full Compensation and Departmental action against Perpetrator/s

02 January 2015: On 01 February 2015, the District Court, Banke gave a ground breaking verdict in a cased filed under Compensation Relating to Torture Act, 2053. In the torture case filed by Jhup Bahadur Bista, a resident of Kanchanpur VDC-7, Banke district, the District Court ordered NPR 1,00,000/- (One hundred thousand) compensation to the survivor and departmental action against the perpetrator/s. With the support of AF, Mr. Bista had filed case on 24 July 2013 against an Assistant Police Inspector, one Head constable and one Constable from Gavarpur Police Station, Agaiya, Banke district.     

According to the victim, on 16 July 2013, he stepped on the leg of a plain clothes policeman while dancing in a festival. Later that evening, he was beaten by 3, 4 plainclothes policemen in a local hotel and arrested on charge of threatening to police. After arrest, he was taken to Gavarpur Police Station, Agaiya, Banke district where his left leg was handcuffed with his right hand and tortured for whole night in different positions by using different objectives.

Due to torture his front teeth was broken and bled for few days. Similarly, he complained of pain in both ears for several days. Till now, he complains of pain in his left ear. Due to torture his left eye was reddened & swelled. There were dark scars on his thighs & scratches on his back.
