26 September 2011. Seeking compensation to victim and departmental action against the perpetrators Mr. Bharat Sharma, 30, temporarily living in Tahachal, Kathmandu has filed a torture compensation case against Area Police Office, Chagal and Area Police Office, Bhagwanpau, Kathmandu under Torture Compensation Act – 1996 on 25 September 2011. He was arrested on 21 August 2011 on the suspicion of stealing money and gold from his neighbor Dhan Bahadur Magar’s apartment in Tahachal on 9 August 2011. After his arrest he was taken to APO, Chagal in Tahachal Kathmandu where he was reportedly handcuffed and tortured for about 3, 4 hours by beating him with sticks. During the inquiry he was reportedly inserted a stick through his handcuffed elbows and bended knees, propped his legs up and beat with sticks on the soles of his feet for about 60, 65 times. Likewise, he was forced to do sit ups and downs by catching his ears.
At around 2 am the same night he was transferred to Bhagwanpau Police Office where too he was reportedly tortured by 4, 5 unidentified policemen by forcing him to stand on his hands while resting his legs on the window panel. Verbally abusing him they allegedly beat on his back, legs and soles of his feet with sticks. Likewise, they kicked on his chest with police boots and punched on his face. Forcing him to lie down on the floor they reportedly stepped on his chest for about 3, 4 minutes. Due to the severe torture he was bleeding from his nose and mouth. The police officers forced him to accept the allegation but he refused requesting that he was innocent.
Police released him on 22 August 2011 after he was found innocent. At present he is receiving treatment and taking rest. He was provided physical and mental checkup for his medical treatment and free legal aid by Advocacy Forum.
