28 February 2013. In its press release of 26 February the Nepal Bar Association (NBA) has once again taken strong exception to the proposal of major political parties to appoint the sitting Right Honorable Chief Justice as the head of the Executive. The press release has also contended the recent press release of the Supreme Court that spoke officially about the position of the Chief Justice in relation to the parties’ proposal.
The NBA has reiterated that the appointment of the sitting Chief Justice as the Executive head is bound to undermine the independence of judiciary and the principle of separation of power. “The Chief Justice’s recent meetings with the political leaders have challenged the values and ideals of the independent judiciary. The move is also against the code of conduct for judges,” reads the statement.
