29 March 2012. The Patan Appellate Court has today quashed the order of the Kathmandu District Court vis-à-vis case forward of torture survivor Arjun Gurung to the Court Mediation Centre. A joint bench of Justice Aakraj Acharya and Hari Kumar Pokhrel has issued an order to reverse the former order of the district court.
On 29 December 2011 Justice Narayan Prasad Pokhrel of Kathmandu District Court had issued an order to forward the case to the Court Mediation Center. The court’s earlier order reads, “This case seems as if it can be resolved through compromise. So, the plaintiff and defendant should be called through their agents within 30 days and sent to Court Mediation Center for reconciliation”.
AF lawyers had pleaded from the victim’s side during the hearing and that the court gave the aforementioned order before the defendant lawyer’s pleading.
