Transitional Justice

Advocacy Forum (AF) is currently overseeing the implementation of various programs on transitional justice in Nepal. AF strongly believes that a comprehensive transitional justice mechanism is needed to address past human rights violations in Nepal and ensure that such violations are never repeated again. We fight to ensure that justice is delivered to those who have suffered. Presently, the legal structure does not have the capacity to address the human rights violations that escalated to a great number during the conflict. As there can be no concrete political stability and democracy without addressing these past abuses, a comprehensive program for transitional justice, including a Truth and Reconciliation Commission and successful criminal prosecutions is needed to lay the foundations for sustainable peace. The goal of these programs is to initiate dialogue throughout the country between victims, various authority stakeholders and civil society. We bring major actors of civil society together to engage with parliamentarians and other stake holders to discuss the needs of victims and to campaign for the creation of a legal framework which addresses accountability adequately. Together with the International Center for Transitional Justice, AF is conducting a survey of victims to find out what is their perception of the justice system. We also help give victims' groups a voice by bringing their message into the public domain.

Goal:
Increasing People's Access to Justice through Transitional Justice Mechanisms

Activities:

  • Workshops and seminars with different stakeholders
  • National Task Force Formation for transitional justice
  • Case filing in order to challenge the perpetrators
  • Formation of victims' group
  • Publication of the experience of transitional justice mechanisms abroad.
  • Empirical survey to find out what victims want and their perspectives on justice
  • Regular publication in the national media of informative articles on transitional justice mechanisms (fellowships will be provided to journalists)
  • Training and Capacity building for lawyers equipping them with the right tools to deal with issues of transitional justice.

Accountability Watch Committee(AWC)

AWC is a national network of individuals and organizations working in the field of human rights. AF established AWC because although there were various initiatives by several human rights organizations demanding accountability, these efforts were fragmented. By uniting the campaigns we hope to finally put enough pressure on the government to address past human rights abuses.

AWC promotes the idea of transitional justice and provides a platform from which to influence and lobby for the establishment of transitional justice mechanisms. This initiative brings key organizations and individuals together to make strategic interventions in demanding accountability where there has been human rights violations. AWC also intervenes in areas of law and policy where humand rights and the rule of law are affected

Objectives
* Intervene in cases of human rights violations when there is an immediate need for accountability.
* Intervene in policy issues that affect the rule of law and human rights.

Membership:
Organizations and individuals working in the areas of human rights, rule of law, general accountability, and transitional justice can be the members of the committee.

Core Committee
Presently, the core committee consists of 13 members. Individuals and organizations that started the initiative are members of the core committee and general members can also be elected.
